Recording versus publishing
At Nikausync we capture conversation, light edit and export in your podcast format. That is technical service; we are not a rights agency. Whether your intro is legal online remains your duty as maker or producer. Sessions start at €165 (two hours, two voices); half day with edit €310; extra editing €65 per hour.
Sort rights before recording — otherwise you pay to cut music later. Contract questions: contact; legal advice from a qualified lawyer.
Copyright and neighbouring rights (brief)
In the Netherlands copyright protects the composition and the master protects the specific recording. Commercial tracks usually have both layers. Without a licence you may not use them in your feed, not «just five seconds» or «quietly under speech».
Narrow exceptions such as quotation do not replace a proper intro licence. Our disclaimer states studio information is not legal advice.
Buma/Stemra, Sena and your tasks
Buma/Stemra often manages composers’ rights in the Netherlands; Sena handles remuneration for performers and producers on public use. Globally reachable podcast feeds are exploitation in practice — platforms report listens, but you remain responsible for the music you use.
Library music with an explicit podcast licence is usually simpler than licensing a chart chorus. Keep licence PDFs and note track IDs in show notes. With co-hosts, agree who clears rights — see terms and conditions on liability.
Royalty-free, Creative Commons and custom
Royalty-free libraries sell use for defined cases; check podcast, monetization and download limits. Creative Commons variants differ: CC BY needs credit, NC blocks commercial use, ND blocks remix — watch NC if you run sponsors.
Commission a custom jingle? Get written assignment of exploitation rights for your show, medium and territory. We can record composers in the studio, but contracts sit outside Nikausync B.V. or with your lawyer. Raw recordings stay in archive 24 months.
Guests, samples and music on mic
If a guest plays or sings a fragment, your feed can still get claims — agree beforehand what is allowed. Samples from records usually need master and publishing clearance. Live covers in the studio do not replace a release licence.
Corporate podcasts with archive music: confirm marketing or HR holds rights. Personal data in episodes falls under privacy policy and sometimes a data processing agreement with your employer.
Practical in our podcast setup
We set two to four dynamic mics at the table with engineer monitoring through glass. Bring intro/outro as a file on USB — we lay it on the timeline where you point. Prefer voice-only with space for music later? We export stems or a music-free mix for your DAW.
Do not play a copyrighted Spotify stream as «background» during recording; it bleeds into mics and is still unlicensed. Silence or room tone works better for later underscore.
Monetization and platforms
Ads, Patreon or paid feeds raise claim risk — platforms run automatic matching. Even brief takedowns cost reach. Document licences and use distinct intros per show to avoid confusion.
Video podcasts add sync rights: music often must be cleared for picture too. Session prices cover recording and basic edit, not music licences. Pair with mix delivery formats if you later want us to integrate music in stereo.
